How to Modify Child Support Without a Lawyer

The first step is arithmetic, not paperwork

Every state in our verified set lets a support order change only when a test is met. Texas: 3 years plus a guideline difference of 20 percent or $100 (Tex. Fam. Code §156.401(a)(2)), or a material and substantial change. Ohio: a recalculation more than 10 percent away from the current amount is itself the substantial change (ORC §3119.79(A)). Florida: a recalculated guideline at least 15 percent or $50 away, whichever is greater (Fla. Stat. §61.30(1)(b)). Illinois: a guideline result inconsistent by at least 20 percent and at least $10 a month (750 ILCS 5/510(a)(2)(A)). New York: 3 years, a 15 percent income change, or a substantial change (FCA §451(3)). California sets no numeric court threshold — a change of circumstances is the showing. Run the test on your numbers before you file anything: that is what the Door 1 checker does, free.

Route one: the agency review (free)

Each state in the set runs a review route that costs nothing to ask for: the Texas OAG Child Support Review Process, California's local agency review and adjustment, Florida DOR review for Title IV-D cases (its FAC 12E-1.041 tiers are alternatives — 10% or $25 at 3 years; 15% or $50 under 3 years — plus a permanent, involuntary change), HFS review in Illinois, and the CSEA administrative review in Ohio. Agencies use their own screens — California's agency screen (20% or $50, whichever is less) is an agency screen only, never a court standard — and an agency can move an order in either direction.

Route two: your own court motion

You may file yourself regardless of any agency screen. The filing date matters more than any other date in the case: a modification runs from filing, service, or notice forward — never back to when your circumstances changed. Every month of delay is a month at the old rate that becomes arrears no court in the set can erase.

The evidence is the case

The discretionary track is never a form — it is paper: termination letter or unemployment filing for a job loss, before-and-after pay stubs and an employer letter for a pay cut, an SSA determination or physician statement for disability, a 12-month overnight log for a timeshare change, and premium statements for insurance changes. The checker prints your state's list as Track B.

Questions

Can I modify child support without a lawyer?
The test, the agency review, and the court motion described on this page are the self-help path the states themselves publish. Many men run the numbers and file the agency review without counsel; a contested hearing is where an attorney earns their fee.
Does filing change arrears I already owe?
No. A modification is never retroactive to when your life changed. Arrears already accrued stay owed — see Door 2 for what can lawfully reduce them.
What if the agency will not move it?
The court route stays open. Agency screens bind the agency, not the court — California says so expressly: either parent may file in court at any time regardless of the agency test.
