California child support arrears forgiveness
Formal program — Debt Reduction Program (current name; formerly Compromise of Arrears Program — COAP, Fam. Code §17560)
ESTIMATE — based on the rules California published, checked October 2026. Only the agency can approve a reduction, and approvals are discretionary.
What can be reduced
Government-owed arrears only, reduced on a calculation of income, assets, family size, local cost of living. Agency states plainly: will NOT forgive the entire debt; will NOT reduce arrears owed directly to the other parent; will NOT reduce spousal arrears; current support unchanged
Who may be eligible to apply
- Parents owing arrears to the government because children received cash aid (CalWORKs) or were in foster care
Where to apply
Local child support agency / CA DCSS
The split still decides it
State-owed (assigned) arrears are the state's to compromise. Family-owed arrears can only be reduced by the other parent's voluntary, documented agreement — no agency can force it. Tennessee is the verified inversion: family-owed arrears are the compromisable slice there with court approval, and state-owed cannot be forgiven. If you do not know your split, the first move is a written request to the agency for the split as separate lines.
Interest and limits
Interest: 10% per year, on the principal of each unpaid installment from its due date (simple interest on unpaid principal; grace: interest does not accrue on a given month's support until the 1st of the following month, Fam. Code §17433.5) (CCP §685.010 (10% money-judgment rate); Fam. Code §§17433.5, 17560; CA DCSS arrears calculator)
Limitations: Enforceable until paid in full, no renewal needed — no limitations period (Fam. Code §291, verified anchor, sizing §5.2)
What no one can do: a judge cannot erase arrears that already accrued for hardship, job loss, or incarceration when no modification was filed at the time (Bradley Amendment, 42 U.S.C. §666(a)(9)(C)). Arrears are not dischargeable in bankruptcy.
Federal lines: arrears over $2,500 can be certified for passport denial or revocation; only the state agency can request a release, and release practice is set by the state.
